Ex-Tyco CEO Kozlowski sues Steve Forbes for libel

NEW YORK, June 1 (BestGrowthStock) – Dennis Kozlowski, the
imprisoned former chief executive of Tyco International Ltd
(TYC.N: ), is suing Steve Forbes and publisher Random House Inc
for libel.

In papers filed Friday with the New York State Supreme
Court in Manhattan, Kozlowski alleged that “false and
defamatory statements” about him were published in Forbes’ 2009
book “Power, Ambition, Glory: The Stunning Parallels Between
Great Leaders of the Ancient World and Today … and the
Lessons You Can Learn.”

The complaint seeks unspecified compensatory damages, plus
punitive damages equal to triple the compensatory award.

John Prevas, a faculty member at Eckerd College in Florida
and co-author of the book, was also named as a defendant.
Forbes is editor-in-chief of Forbes magazine, and Random House,
publisher of the book, is owned by Germany’s Bertelsmann AG

The defendants did not immediately return calls or were not
immediately available for comment. Alan Lewis, a lawyer for
Kozlowski, had no immediate further comment.

Kozlowski, 63, is serving an 8-1/3- to 25-year prison
sentence after a Manhattan jury in 2005 convicted him of grand
larceny, securities fraud and falsifying business records.

Prosecutors said Kozlowski stole from Tyco in part to
support a lifestyle that included a $2 million birthday party
in Sardinia for his wife and a $6,000 shower curtain.

The case is separate from Kozlowski’s effort to recover
from Tyco $75.9 million of retirement money he believes he is
owed. In that case, Tyco is trying to recover from Kozlowski
$505.8 million of benefits it said it awarded him between 1995
and 2002, when he left the company [ID:nN16131587].

Robert Shwartz, a lawyer for Kozlowski in that case, was
not immediately available for comment.

The latest case is Kozlowski v. Forbes et al, New York
State Supreme Court, New York County, No. 107094/2010.
